sorry to interfer here. But the first you shlould ask yourself is, where does the trouble begin?
And in my opinion the issue starts, when someone starts to try to brake a runinng eBay auction. Please don't get me wrong I also tried this in the past. And the next thing is, why does anyone try to break a running auction? Because he wants to fool the seller by getting the watch under the market value.
So my conclusion is, if you have tried to brake rules and you are not successful in the end, because someone else jumps, there is no reason to complain!!! In the end the seller gets a price closer to the value of the item he has, what seems to be fair to some spectators.
Of course this is just valid for side deals in running ebay auctions. BIN is a different story!
