I am not a lawyer but I am a photographer who has dealt with copyright laws...which are enforceable if you want to spend the money. Like copyright laws a binding contract is also enforceable...but only if your are willing to pursue/pay to enforce it. I doubt eBay allows this to happen for the fees. I am sure they "allow" it because they know that buyers will rarely pay to enforce it and that if they tried to enforce it...even by banning people they would probably have legal hassles and fees worse than they have by not enforcing.
