You can also mention that when you purchased the watch you entered into what the law terms a "good faith contract". You gave the dealer your money in good faith and in return you expected to receive a properly functioning watch. As you did not receive this, the dealer has what the law terms a "duty" to replace the watch or give you a refund in order to maintain the good faith contract. If they do not, they have violated that as well as the implied warranty of merchantability.
Bottom line...DO NOT leave that store without a full refund or a new watch on your wrist, regardless of what bulls**t they try to tell you!!!!!
