I recently purchased a full size Omega Seamaster Professional from a retailer in the City of London.
Having had the watch for just over six weeks, I dropped it, from a height of no more than 2 feet, onto soft carpet.
To my astonishment, upon picking the watch from the floor, I discovered that the second hand had now detached itself from the movement and was rattling around freely inside the watch face!!!
I returned the watch to the retailer and demanded a replacement or a refund. They are currently refusing and are claiming that a scratch on the bezel indicates that the watch has suffered a 'knock' and that it can only be repaired under the terms of the guarantee.
I can certainly not recollect a knock of severe magnitude over normal usage. Given that it is my first new watch in 7 years and that I like it very much, I think that I would notice!!
Can anyone provide advice / comments on this please?
1) Is this a common problem with Seamaster's. If it is, I find that v. difficult to believe given it is a diver's watch which is designed to withstand shock / pressure.
2) What is my position with Omega / retailer? Can I force them to provide me a replacement / refund?
3) What is my position under UK consumer law? I am viewing that the goods are not fit for purpose and I believe that there is a section under the Consumer Goods Act of 1974.
4) Failing a replacement / refund and if the watch is repaired, how robust will it be?
