That depends on the law of the place where you live. (I am in the UK, so treat any advice with caution if you are not!)
There is a pretty strong market (on Ebay if nowhere else) for vintage Omegas so you should - in theory - be able to replace it with something broadly similar. This makes it difficult to argue for the cost of a brand new watch!
I suggest using the prices from STS site (in my earlier post) as these are probably double the Ebay prices. The STS watches are serviced to a very high standard and come with a guarantee. On Ebay, you can sometimes take pot luck.
Or you could argue for an amount based on Ebay sale prices with the cost of having a full service carried out thereafter. A service in the UK for this type of watch is about £170 (STS again, the "official" agents for vintage repairs). In reality you can actually get a decent service for half that price (www.chealwatch.co.uk)
