I agree with Chuck's poker analogy.
This seller surely doesn't want his name and reputation being splashed and bashed across the #1 Heuer forum, especially if he really is in the wrong. Knowing this you should have some leverage to reach a fair deal with maybe some compromise on both sides. But once you out him he no longer has any incentive to work with you.

At this point you both should be thinking of cutting your losses and damge control. The seller knows you will never be a customer again but he needs to minimize the number of future clients your bad publicity could cost him.

And you need to weigh the cost of recouping some of your money versus the satisfaction of exposing and slamming this guy to the whole community and getting nothing financial in return.

So here is a baseball analogy for you;
Pitch him high and inside but don't throw the bean ball yet. He'll get the message to back off the plate or get ready to duck cause he knows where the next one is going.

This first post was a good start to let the seller know you are willing to name names and play hard ball so you may want to now re-establish communication and negotiations. I'm sure your are mad and frustrated but relax because time is on your side. You can always burn him later if he won't bargain in good faith and you know you have nothing further to loose.

But to be fair if you do reach an agreement you should then post stating this to help validate his credibility. He would deserve this.
