Some Plain English / Not Lawyer Talk


Let me try to put this in plain English.

  • OnTheDash has approximately 3,000 images on the website -- photos and scans

  • some of these photos are mine; many been submitted / sent-in by readers all around the world . . . maybe 60 or 80 different guys

  • to take a single photo, and put it on the website (or to put it on this discussion forum), requires considerable effort -- download; rename; resize; upload; add caption; etc. . . . hundreds or thousands of hours, when you consider the entire website . . . still, I am usually happy to do this -- good for the website / good for our readers

  • it also takes a considerable effort to track "which photos are where on the website?" and "which photos came from which reader?"

  • I have uploaded and managed every single one of these images, all by myself . . . nothing particularly heroic, but it may help you understand the human element of this whole thing . . . hundreds or thousands of hours of effort

  • this is why I have the language in the "legalese" that says that someone who submits a photo to OnTheDash gives OnTheDash the right to continue to display it, forever . . . I would never add a photo, if the person who submitted it insisted on the right to pull it, whenever he felt like it . . . this just would not be workable

  • for anyone to come along and demand that I remove all their photos immediately (or even over the course of a few days, weeks or months) is impossible and unfair -- it will damage the website; it will waste too much of my personal time; it sets a bad precedent . . . you can take your marbles and go home, but you can't take my marbles or the marbles that you contributed to the group.

I hope that this helps you understand why I cannot agree to remove specific photographs whenever demanded by one of our readers / photographers. I appreciate all the photographs, and all the photographers, but I cannot be subject to these sorts of demands. It's just not workable, with a "hobby" website, for which a single person manages all the iamges.
